1. Acceptance of Terms
By engaging Opus Publishing Co. for any service — whether editing, formatting, cover design, or publishing and distribution — you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not proceed with our services.
These terms apply to all clients, regardless of how the engagement was initiated (email, website form, or otherwise). Opus Publishing Co. reserves the right to update these terms at any time. Continued use of our services constitutes acceptance of any revised terms.
2. Scope of Services
Opus Publishing Co. provides professional editing, formatting, cover design, and publishing distribution services for independent authors. The specific scope of work for each project is agreed upon in writing prior to commencement.
Services include but are not limited to: Developmental Editing, Line Editing, Copy Editing, Print Formatting (IPS-compliant), eBook Formatting (KPS-compliant), Cover Design, and Publishing & Distribution via Amazon KDP, Barnes & Noble Press, Apple Books, and Kobo.
The exact deliverables, revision rounds, and timeline for each project will be specified in a project proposal or service agreement provided before work begins.
3. Fees and Payment
All fees are quoted on a per-project basis and communicated to the client prior to commencement. Opus Publishing Co. does not charge hidden fees or recurring costs beyond those explicitly agreed upon.
Unless otherwise specified, a deposit of 50% of the total project fee is required before work begins. The remaining balance is due upon project completion and prior to delivery of final files.
Payments are accepted via bank transfer or other methods as agreed. All prices are in the currency specified in your project proposal. Quotes are valid for 30 days from the date of issue.
Late payments may delay project delivery. Opus Publishing Co. reserves the right to suspend work on projects where payment terms are not honoured.
4. Intellectual Property and Rights
All rights to your manuscript, cover design, and associated creative work remain entirely with you, the author. Opus Publishing Co. does not claim any ownership, licensing, or royalty rights over your work at any stage of the engagement.
You grant Opus Publishing Co. a limited, non-exclusive licence to access, read, and work on your manuscript solely for the purpose of providing the agreed services.
Opus Publishing Co. will not share, reproduce, distribute, or disclose your manuscript or project details to any third party without your explicit written consent, except where required by law.
Upon full payment, all formatted files, cover design assets, and deliverables produced by Opus Publishing Co. for your project become your property.
5. Confidentiality
Opus Publishing Co. treats all client manuscripts, project details, and communications as strictly confidential. We do not discuss, share, or reference client work publicly without written permission.
We may request your permission to list your published title in our portfolio or website. This is entirely optional and will never be done without your explicit consent.
6. Revisions
The number of revision rounds included in each service is specified in your project proposal. Revisions are defined as changes based on the original agreed scope. Requests that substantially change the scope of work (e.g., adding significant new content, restructuring a manuscript after line editing has begun) may be subject to additional fees.
Revision requests must be submitted within 14 days of delivery of the edited or designed work. After this period, additional revision work may be quoted separately.
7. Turnaround Times
Estimated turnaround times are provided in your project proposal and are based on the scope of work and Opus Publishing Co.'s current workload at the time of engagement.
Turnaround times are estimates, not guarantees. Opus Publishing Co. will communicate proactively if a deadline cannot be met and will work with you to find an acceptable solution.
Delays caused by late client responses, incomplete manuscript submissions, or last-minute scope changes are not the responsibility of Opus Publishing Co.
8. Client Responsibilities
You are responsible for submitting your manuscript in the agreed format (typically Microsoft Word .docx unless otherwise specified) and ensuring it is reasonably complete before editing begins.
You are responsible for reviewing and approving all deliverables within the agreed timeframe. Failure to do so may delay final delivery.
You represent that you are the sole author and rights holder of the submitted manuscript, or that you have the appropriate permissions to have the work edited and published. Opus Publishing Co. accepts no liability for copyright infringement or other legal issues arising from content you have submitted.
9. Cancellation
Either party may cancel a project engagement with written notice. If you cancel after work has commenced, the following applies:
- If cancellation occurs before 50% of the agreed work is complete, any paid deposit is non-refundable. - If cancellation occurs after 50% or more of the work is complete, the full project fee is payable.
Opus Publishing Co. reserves the right to terminate an engagement if client conduct is abusive, if payment terms are not honoured, or if the submitted content violates applicable laws.
10. Limitation of Liability
Opus Publishing Co.'s liability for any claim arising from our services is limited to the total fees paid by the client for the specific project in question.
We are not liable for: lost sales or revenue after publication, changes in platform policies (e.g., Amazon KDP, Apple Books), errors introduced after our work has been approved and delivered, or any indirect or consequential losses.
Opus Publishing Co. does not guarantee commercial success, bestseller status, or any specific level of readership for any published title.
11. Governing Law
These Terms and Conditions are governed by applicable law. Any disputes arising from these terms or our services shall be resolved in good faith. If a resolution cannot be reached, disputes may be referred to mediation before any legal action is pursued.
